Holding
The court held that a letter from the grantee to the potential heirs created an express trust in their favor for a one-third interest in real property, despite a mistaken description of the share, but that a prior probate decree distributing the entire estate to another heir could not be collaterally attacked through a claim of involuntary trust based on mistake.
