Holding

The court held that a transferee who purchases land from the Central Pacific Railroad Company with full knowledge of a prior applicant's equitable interest, cultivated possession, and improvements, acquires no superior right to the property, and that an administrator's sale of a decedent's equitable interest in such land does not constitute an abandonment of the applicant's contractual rights with the railroad.
