Holding
The court held that the complaint stated a valid cause of action, concluding that the executors of the last surviving partner were the proper parties to sue on a partnership debt without joining the representatives of the predeceased partner, that a part payment of interest evidenced by a written memorandum tolled the statute of limitations, and that the allegations sufficiently pleaded the alter ego doctrine to impose individual liability on a corporate shareholder.
