Holding

The court held that a complaint to enforce an oral contract to make a testamentary disposition failed to state a cause of action because it did not join the decedent’s heirs as indispensable parties and because the action, in effect a suit to impress a trust upon the residue of an estate, could not proceed against an administrator or bona fide purchasers.
