Holding
The court held that a beneficiary of an express trust is not relegated to the status of a general creditor when the trustee commingles trust funds with his own in a solvent estate, and that a court may impose a constructive trust on the commingled funds to the extent the original trust corpus can be traced, even after the trustee’s death.
