The court held that a probate administrator may maintain an action in equity to recover possession of estate property and forfeit a deposit from a defaulting purchaser at a probate sale, and that the statutory remedy of petitioning for a resale under Code of Civil Procedure section 1554 is not the estate’s exclusive recourse.
