The court held that a decree of distribution from a probate proceeding is not conclusive as to the rights of parties arising from a separate contract or conveyance made between heirs concerning their shares of the estate, but that a plaintiff's claim to enforce an oral trust may nonetheless be barred by the equitable doctrine of laches due to unreasonable delay in asserting the claim.
