Holding
The court held that a constructive trust arose in favor of the beneficiaries based on the grantee's promise, and that the trustee’s subsequent grantee, having paid no consideration, took the property subject to that trust. The court further held that the trustee bore the burden of proving that transactions with the beneficiaries were fair and free from undue influence, a burden which his grantee failed to meet.
