Holding

The court held that a grantee who pays no consideration for a deed, where the consideration is instead furnished by a third party, holds the property as a constructive trustee for the party who actually paid. Furthermore, in an action to quiet title, a plaintiff may introduce evidence to show they are the equitable owner and that the defendant holds legal title in trust, even if the complaint does not specifically plead a resulting trust.
