Holding

The court held that a father’s conveyance of real property to three of his four children, made after he had entered into a binding agreement to devise his entire estate equally to all four, constituted a violation of that agreement and a constructive fraud upon the excluded child, and that the heirs of the deceased were properly authorized under the Probate Code to bring a quiet title action to return the property to the estate for administration.
