Holding
The court held that an irrevocable inter vivos trust, voluntarily created by the settlor for his own benefit and that of his heirs, was valid and enforceable; that the trustee’s resignation did not terminate the trust but triggered the appointment of a successor trustee; and that the trustee was entitled to indemnification from the trust estate for expenses reasonably incurred in defending the trust against attack.
