Holding
The court held that the Real Estate Brokers Act of 1919, as amended (now codified in the Business and Professions Code), did not apply to a contract for the sale of unsubdivided acreage to a subdivider who would subsequently subdivide and sell the property to the public, and that a vendor who holds title subject to a trust deed may still be considered the owner in fee simple for the purposes of such a contract, absent any fiduciary relationship or fraudulent misrepresentation.
