The court held that a testator’s general disinheritance clause and nominal $10 substitutional gift to any contesting heir does not constitute a valid disposition of property that would otherwise pass by intestacy, and thus does not prevent the decedent’s statutorily protected relatives from successfully challenging charitable bequests that exceed the one-third limitation imposed by Probate Code section 41.
