Holding
The court held that the trial court erred in granting a nonsuit because the plaintiff presented sufficient evidence to establish triable issues of fact regarding the existence of an enforceable contract between decedents to make mutual wills, the terms of that agreement, the continued existence of the wife's will at her death, and the plaintiff's standing as a third-party beneficiary to enforce the contract against the surviving spouse's successor.
