The court held that the trial court erred in sustaining a general demurrer to the first cause of action for imposition of a constructive trust, as the complaint adequately pleaded the elements of Civil Code section 2224, but correctly sustained demurrers to the subsequent causes of action seeking personal liability against the executors.
