Holding

The court held that a judicial vacancy, for purposes of article VI, section 16, subdivision (c) of the California Constitution, arises only upon the death or surrender of office by an elected incumbent and continues to exist until an elected successor takes office, regardless of any temporary gubernatorial appointments made to fill it in the interim. Consequently, an election scheduled to fill that original vacancy must proceed as calendared.
