The court held that a trustor who is the life beneficiary of an irrevocable trust but who has created a remainder interest in his surviving lawful issue and possesses only a testamentary power of appointment is not the sole beneficiary of the trust and therefore cannot terminate it without the consent of all beneficiaries.
